Software Installation File Distribution

You may freely distribute the software install file that can be downloaded from this website.  Each person outside of your family/household must puchase a SEPARATE license/copy of the program to use it.  A unique Request Code and Order Number must be submitted (Get Registration Code) to obtain the unlocking Registraton Code.

This file may not be de-compiled, reverse-engineered or transforemed into any other electronic or writen medium.

Software Use Agreement and Warranty

By installing and using your copy of this Software, you indicate that you agree to the following terms, restrictions, rights, and limitations.  Berky Information Teknologies, Inc. agrees to uphold the Software Warranty as listed below.

Terms of Use:

If purchased for personal/private use, this Software may be used by all the members of a single household.  This Software may be installed on up to 3 computers that are used only by the members of the household.

If purchased for business/commercial use, this Software may be used by one employee on as many computers as are used solely by that employee (eg., office, home, laptop).  Or, if this Software will be used by multiple employees, it may only be installed on one computer workstation.  Installation on a network server, intranet, Internet or other remote access method where multiple users are granted access is not authorized for this version of the Software.  Please contact your retailer or Berky Information Teknologies, Inc. for multi-user/network installation versions.  If the Software will be regularly used by multiple employees on different computer workstations, additional copies should be purchased for each employee or workstation.

Restrictions:

You may not, and you may not permit others to make copies of this Software for resale or redistribution in any form.  You may not install this Software on a network server, intranet, Internet or other remote access method where multiple users are granted access.

Rights:

You may rent or lease this Software to a single third party that qualifies for use under the Terms of Use paragraphs above, provided you are not also using the Software.  You may sell or give this Software to a third party subject to the Terms of Transfer listed below.  You may contact Berky Information Teknologies, Inc. at anytime for questions or comments about the software.  Contact information is listed below.

Terms of Transfer:

If the ownership of your copy of the Software is sold, given or transferred in any way to a third party, that party must receive all physical and non-physical elements of the Software package and you must delete or destroy all copies (and old versions) of the Software installed on all computers you use.

If you sell, give or transfer ownership of a computer on which this Software is installed, you must remove the software or transfer your ownership of the Software according to the terms of the preceding paragraph.

Software Warranty:

Berky Information Teknologies, Inc. warrants that this Software will perform as indicated in our authorized marketing materials, user guide and help information.

Any known errors or updates to the software will be posted on our web site at http:// www.simplemoneysolution.com/updates.htm. Updates and fixes will be available as a free download from the same web address.  There may be a charge to download any substantial upgrades or enhancements to the software.  Charges for upgrades will not exceed the original purchase price of the Software.

If, within 30 days of your purchase, you determine that this Software does not meet our descriptions based on our authorized marketing materials, you are entitled to a full refund of the purchase price, provided you remove from your computer(s) all installed copies of this Software and return all materials, in good condition, to your retailer or vendor.

Disks damaged during the first year after purchase will be replaced without charge.  Damaged disks must be mailed to Berky Information Teknologies, Inc. for the free replacement.  After that period, you may be charged for replacement disks.

Warranty & Liability Limitations

This warranty will be void if you engage in any activity that violates the aforementioned Terms and Restrictions.  This warranty will also be void if you alter the Software program files or data files with any third party software or hardware tool.  This Software is not designed to be installed or run through a network.  Support for such installations will be subject to a fee and is not guaranteed.

This software is not designed to give any professional or legal advice on finanical or other matters.  Review all financial, tax and legal decision with a competent professional.  Any actions you take based on your use of this software are solely your responsibility, regardless of the accuracy or appropriateness of any information supplied or created by this Software.  Any illegal activities in which you engage while assisted by, or through the use of this Software are solely your responsibility.

Berky Information Teknologies, Inc. cannot be held liable for any loss or damages to your computer hardware or software through the possession or use of this Software above the cost of the Software.  Berky Information Teknologies, Inc. cannot be held liable for any actions taken by third-party retailers, vendors, or resellers of this software.
